Grantham | Cencarik, PC maintains a dedicated Massachusetts litigation and trial practice that seeks both legal and equitable remedies for its clients. Our trial attorneys represent both businesses and consumers as both Plaintiffs and Defendants in civil litigation matters. We also represent parties in a variety of disputes before they become lawsuits, and can assist in finding a satisfactory resolution through negotiation or mediation.

Why Hire Us?

Our litigation attorneys have years of experience representing clients in Massachusetts in both state and federal courts. You can expect honesty from your attorney about your case and results. We strive to keep our litigation clients informed about the progress of their case and provide you with enough information so that you can make informed decisions.

Our Philosophy

Our philosophy is to be both assertive and professional. Our attorneys will help bring closure to unresolved and complex situations, either by a civil action, mediation, or settlement negotiations. Our attorneys use the legal process to enforce and protect your rights, and find the best solution that meets your individual needs.

Settlement or Trial: The Choice is Yours

In most cases it is in the interest of all parties to try to reach some type of settlement resolution before going to trial. We advise our clients on all options throughout our representation and have the ability to create and propose clear solutions that make sense for all parties involved. However, some matters cannot be resolved outside of a trial. In this case, we are ready and willing to go to trial for you.

The Litigation Process

  • Demand Letter: Typically, once a party is harmed, an attorney will draft and prepare a demand letter. The demand letter serves to put the other party on notice and possibly initiate a settlement prior to having to file a complaint.
  • Complaint/Answer: If the issues between the parties cannot be resolved, then it is necessary to file a complaint. In a complaint, the “plaintiff” files with the court a summary of what happened, alleges how he was harmed and a demand. The Defendant in the lawsuit then files an answer to the Plaintiff’s complaint and if he has any claims against the plaintiff, he will file a complaint against the plaintiff, also known as a counterclaim.
  • Discovery: The discovery phase of litigation is long and drawn out. During this phase, the parties to a lawsuit will request information from the opposing parties. These questions can be in the form of written questions, known as interrogatories, or oral questions, known as depositions. Moreover, the parties can also request documents from the opposing party.
  • Motions: Throughout the litigation process each party may file a request for relief with the court; something known as a motion. A motion is simply a request that the court do something for a party, such as dismiss a case; or force a party to do something, such as produce documents. With a motion, a judge hears both sides and then makes a decision.
  • Trial: if no settlement is reached, and there are factual issues to be decided, then there is a trial. During trial, each party presents evidence and witnesses in an effort to prove their case. Less than one percent of all litigation cases actually go all the way to trial.
