The Litigation Process

  • Demand Letter: Typically, once a party is harmed, your attorney will draft and prepare a demand letter. The demand letter serves to put the other party on notice and possibly initiate a settlement prior to having to file a complaint.
  • Complaint/Answer: If the issues between the parties cannot be resolved, then it is necessary to file a complaint. In a complaint, the “plaintiff” files with the court a summary of what happened, alleges how he was harmed and includes a demand for damages. The Defendant in the lawsuit then files an answer to the Plaintiff’s complaint and if he has any claims against the plaintiff, he will file a complaint against the plaintiff, also known as a counterclaim.
  • Discovery: The discovery phase of litigation is long and drawn out. During this phase, the parties to a lawsuit will request information from the opposing parties. These questions can be in the form of written questions, known as interrogatories, or oral questions, known as depositions. Moreover, the parties can also request documents from the opposing party.
  • Motions: Throughout the litigation process each party may file a request for relief with the court; something known as a motion. A motion is simply a request that the court do something for a party, such as dismiss a case; or force a party to do something, such as produce documents. With a motion, a judge hears both sides and then makes a decision.
  • Trial: if no settlement is reached, and there are factual issues to be decided, then there is a trial. During trial, each party presents evidence and witnesses in an effort to prove their case. Less than one percent of all litigation cases actually go all the way to trial.
