What is Bankruptcy?

Personal Bankruptcy in Massachusetts
If your debts are mostly personal debts, in most cases you and our spouse will file under either Chapter 7 or Chapter 13 Bankruptcy.
- Chapter 7 Bankruptcy is a "liquidation" whereby certain assets can be sold by the Court to repay your debt. The assets that can be sold are known as "non-exempt" assets. However, since most people who file for Chapter 7 do not have any non-exempt assets, they generally get to keep all their property.
- Chapter 13 Bankruptcy is a "reorganization", whereby an individual or married couple who have sufficient income will repay a portion of their debt over the course of 3-5 years. Chapter 13 is also used to allow a homeowner to stop a foreclosure and repay the arrears on their mortgage over 3-5 years.

Business Bankruptcy in Massachusetts
Massachusetts businesses who need relief from their debts have the option of filing either a Chapter 7 or Chapter 11. Under a Business Chapter 7 the business closes its doors and all assets are sold (or "liquidated") to repay creditors. After the liquidation, the business closes and stops all operation.
In a Chapter 11, the business continues to operate while the business debts and contracts are "reorganized" to allow the business to return to profitability.
