What is Bankruptcy?

Bankruptcy is a legal process used to help individuals and businesses eliminate their debts or repay them with the protection of the bankruptcy court. Bankruptcies can generally be described as "liquidations" or "reorganizations."

• Chapter 7 Bankruptcy is a "liquidation bankruptcy" whereby certain assets can be sold by the Bankruptcy Court to repay your creditors. The assets that can be sold are known as "non-exempt" assets. • Chapter 13 Bankruptcy is a "reorganization" type of bankruptcy, whereby you get to keep your property and you make monthly payments over the course of 3-5 years to repay a portion of your debt.

Business Bankruptcy in Massachusetts

Most Massachusetts businesses who need to file bankruptcy may file under either a Chapter 7 and Chapter 11. Under a Business Chapter 7 Bankruptcy the business ceases to do business and all assets are sold (or "liquidated") to repay creditors. Under a Chapter 11 Bankruptcy, the business continues to do business while the business debts are "reorganized" to allow the business to return to profitability.
