What is Bankruptcy?

Bankruptcy is a legal process used to help people and businesses eliminate or reduce their debts with the protection of the federal court.

Personal Bankruptcy in Massachusetts

If your debts are mostly personal debts, in most cases you and our spouse will file under either Chapter 7 or Chapter 13 Bankruptcy.

  • Chapter 7 Bankruptcy is a "liquidation" whereby certain assets can be sold by the Court to repay your debt. The assets that can be sold are known as "non-exempt" assets. However, since most people who file for Chapter 7 do not have any non-exempt assets, they generally get to keep all their property.
  • Chapter 13 Bankruptcy is a "reorganization", whereby an individual or married couple who have sufficient income will repay a portion of their debt over the course of 3-5 years. Chapter 13 is also used to allow a homeowner to stop a foreclosure and repay the arrears on their mortgage over 3-5 years.

Business Bankruptcy in Massachusetts

Massachusetts businesses who need relief from their debts have the option of filing either a Chapter 7 or Chapter 11. Under a Business Chapter 7 the business closes its doors and all assets are sold (or "liquidated") to repay creditors. After the liquidation, the business closes and stops all operation.

In a Chapter 11, the business continues to operate while the business debts and contracts are "reorganized" to allow the business to return to profitability.
